Dispute Resolution | 5 New Essential Regulations for Online Fixed-Odd Betting Companies Operating in Brazil

The Brazilian Prizes and Betting Secretariat (SPA) has released five new regulations governing online fixed-odd betting in Brazil.

1. SPA Ordinance No. 1,207: establishes the technical requirements for online games and live game studios that must be observed by operating agents;

2. SPA Ordinance No. 1,212: establishes procedures for the transfer of the destinations of the proceeds from the fixed-odds betting lottery;

3. SPA Ordinance No. 1,225: establishes rules for the monitoring and supervision of fixed-odds betting activities;

4. SPA Ordinance No. 1,231: establishes rules and guidelines for responsible gaming and for communication, advertising, and marketing actions;

5. SPA Ordinance No. 1,233: regulates the administrative sanctioning process for the exploitation of fixed-odds betting.

The publication of these regulations was eagerly awaited by the market, as the deadline for applications for the federal license for companies wishing to operate from 2025 ends on August 20, 2024.

Compliance with the guidelines provided in the regulations above is important to avoid the application of penalties provided for in Law 14.790/2023, such as fines, partial or total suspension of betting activities, prohibition of certain types of operations, among others.
